Terms – this document setting out the principles of operation of websites operated by Moleke.
Customer – an entrepreneur who is a natural person, legal person, or an organizational unit without legal personality granted legal capacity by law.
User – any person using the Platform.
Controller – a natural or legal person, public authority, entity, or any other body which alone or together with others determines the purposes and means of the processing of personal data.
Platform – websites operated by Moleke.
Exclusion of Consumers: Moleke’s services are not addressed to consumers (i.e., natural persons performing a legal act with an entrepreneur that is not directly related to their business or professional activity). For the removal of doubt, Moleke informs that the services and products provided by it are addressed exclusively to entrepreneurs (B2B relationship) and consumer rights provisions do not apply to them. By accepting the Terms, the Customer declares that the legal act performed between the Customer and Moleke is directly related to the Customer’s economic or professional activity.
§ 2. General Information
The Platform is owned and operated by Moleke.
The information contained on the Platform is informative and relates to Moleke’s activities, including offering our partners’ products and organizing workshops.
The Terms are made available to every User free of charge. The Terms may be updated and changed, particularly due to changes in applicable law.
Before using the Platform, each User should read the Terms.
The use of the Platform must comply with the Terms, generally applicable law, internet usage principles, and rules of social conduct.
Content available on the Platform:
Moleke is responsible for its own content published on the Platform.
Information on the Platform is updated regularly. Despite our best efforts, situations may occur where content is outdated, incorrect, or incomplete. If you identify such a case, we would be grateful if you informed us.
Moleke reserves the right to change, add, or withdraw information concerning our partners.
Binding information regarding our offer can only be obtained through direct contact (via the contact form, chat, or email).
Moleke may place links on the Platform to websites operated by third parties. Moleke is not responsible for the content or changes made by third parties to these linked websites. If you notice a suspicious link or website, please let us know – we will respond immediately.
Content on the Platform, particularly blog posts, is covered by copyright.
Minimum technical requirements:
The User may access the Platform via a computer, mobile phone, or other mobile device.
System and hardware requirements: 1000 MHz processor, 512 MB RAM, Internet access, a web browser supporting HTML5, CSS3, and JavaScript with cookies enabled.
User obligations:
By using the Platform, you must not infringe the rights of third parties or Moleke.
In the event of a violation of applicable rules, Moleke reserves the right to demand compensation for damages suffered.
Registration is not required to use the Platform. Providing personal data may be necessary if you wish to express interest in an offer or contact us via contact form or chat.
Copying, reproducing, or distributing content from the Platform without Moleke’s consent is prohibited.
§ 3. Personal Data and Security
The Customer bears full responsibility for the accuracy and truthfulness of the provided data.
Detailed information regarding personal data processing, the rights of Users/Customers, and Moleke’s obligations in this regard is available in the Privacy Policy. Please familiarize yourself with the Privacy Policy before using the Platform.
§ 4. Final Provisions
Moleke makes every effort to ensure that the Platform functions properly and is user-friendly, but cannot guarantee uninterrupted availability due to circumstances beyond its control.

Partner Program Regulations
§ 1. Definitions
Terms and Conditions – this document setting out the operational rules of the Partner Program. Acceptance of the Terms and Conditions is mandatory in order to participate in the Partner Program.
Partner Program – the program aimed at recommending Services provided by Moleke to customers by the Partner and transferring Leads to Moleke under the rules specified herein, for which the Partner receives remuneration.
Moleke – Moleke Prosta Spółka Akcyjna with its registered office in Wrocław, ul. Rynek 60/2, 50-116 Wrocław, Poland, entered into the Register of Entrepreneurs maintained by the District Court for Wrocław-Fabryczna in Wrocław, VI Commercial Division of the National Court Register (KRS) under KRS no.: 0000984003, share capital: PLN 10,000, Tax Identification Number (NIP): 8971909332, acting as the organizer of the Partner Program.
Partner – an entity that joins the Partner Program via the website, accepts the Terms and Conditions, and recommends the Services. Only entrepreneurs (natural persons, legal persons, or organizational units conducting business or professional activity on their own behalf – B2B relationship with Moleke) may become Partners. The Partner receives remuneration from Moleke for each Service agreement effectively concluded by Moleke with a Customer recommended by the Partner.
Customer – an entity interested in purchasing Services, recommended by the Partner.
Lead – contact details of a Customer provided to Moleke by the Partner.
Personal Data Protection Rules – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR), the Polish Personal Data Protection Act of 10 May 2018, as well as other applicable national legal provisions.
§ 2. Partner
Moleke provides the Partner with a website through which the Partner can join the Partner Program and accept the Terms and Conditions. To join, the Partner's contact details must be provided. After submitting them via the contact form and accepting the Terms and Conditions, Moleke will arrange a meeting with the Partner to establish the financial conditions of cooperation. The Partner has access to the current content of the Terms and Conditions at any time.
Any entrepreneur may become a Partner, with the exception of employees and associates of Moleke and entities affiliated with Moleke (personally or by capital).
Participation in the Partner Program is voluntary, and the prerequisite for joining is providing the Partner's contact details via the contact form and accepting the Terms and Conditions.
The Partner is obliged to provide truthful data in the contact form. If untrue data is provided, Moleke is entitled to refrain from contacting the Partner, delete the Partner's data from the database, and refuse payment of remuneration.
In the contact form, the Partner must provide the following information:

company name,
NIP (Tax Identification Number),
telephone number.
After determining the financial conditions of cooperation, the Partner is obliged to provide all data necessary to receive remuneration and fulfill tax obligations according to applicable law. Failure to provide necessary information obliges Moleke to refuse payment of remuneration. The Partner is obliged to inform Moleke of any changes to their data during the Partner Program under pain of exclusion.
Participation in the Partner Program does not constitute an authorization for the Partner to act on behalf of or for the benefit of Moleke, submit declarations of intent, or determine conditions of cooperation with Customers (including making offers or conducting negotiations). All arrangements regarding cooperation between Moleke and the Customer are made directly by Moleke's representative.
Partners may not use Moleke's logo or the logos of Moleke's affiliated entities/partners within their Lead generation activities without prior consent.
§ 3. Partner Program Rules
The Partner receives remuneration from Moleke for each effectively concluded agreement for Services between Moleke and a Customer based on Leads provided by the Partner.
Moleke establishes financial conditions of cooperation with each Partner individually after submission to the Partner Program and acceptance of the Terms and Conditions. Moleke appoints representatives responsible for the Partner Program, including arrangements regarding financial terms.
Moleke reserves the right to arrange financial conditions with each Partner individually depending on the type of Services ordered by the Customer. Financial terms will be confirmed by Moleke and the Partner in electronic form. For active taxpayers of tax on goods and services (VAT) not benefiting from exemption, the remuneration amount will be increased by due VAT according to the rate applicable on the payment date.
By the end of each calendar month, Moleke shall inform the Partner of the number of Customers who signed Service agreements based on provided Leads and information on invoices paid by Customers.
Within 7 days of receiving the information specified in § 3.4 of the Terms and Conditions, the Partner shall issue a VAT invoice (its amount depending on Customer payments for ordered Services) and send the electronic invoice to Moleke at: hello@moleke.com.
Moleke shall pay remuneration within 14 days of delivery of a properly issued invoice to the bank account specified on the invoice.
The Partner shall appoint an authorized person to contact Moleke and transfer Leads.
A provided Lead cannot contain data of a Customer who:
already uses Moleke Services,
is in the phase of negotiating terms of cooperation with Moleke for any services offered at the time the Lead is provided,
has cooperated with Moleke within the last 12 months counted to the Lead submission date.
A valid Lead consists of:

Data sent by the Customer by completing the contact form on the Partner's website.
The Partner may provide an unlimited number of Leads to Moleke during the Partner Program.
The Partner may resign from participation in the Partner Program at any time by sending relevant information in electronic form to Moleke at the address specified in § 5.7. In the event of resignation, the Partner retains the right to remuneration if the Customer concludes a Service agreement with Moleke by the end of the month following the resignation day.
If during the Partner Program Moleke finds that the Partner's actions are contrary to the provisions of the Terms and Conditions or legal provisions, Moleke has the right not to pay remuneration or to adjust the remuneration amount.
Moleke has the right to exclude the Partner from the Partner Program or refuse to recognize a Lead if actions of the Partner or Customer violate the Terms and Conditions or applicable law.
If Customer data provided by the Partner is false, obtained in violation of Personal Data Protection Rules, or provided without consent for offer presentation, Moleke reserves the right not to pay remuneration for the Lead containing such data.
It is strictly forbidden for the Partner to recommend Services to itself or its affiliated entities. In this situation, § 3.12 of the Terms and Conditions shall apply.
§ 4. Personal Data Protection
Detailed information regarding personal data protection is available in our Privacy Policy. Please familiarize yourself with the Privacy Policy before accepting the Terms and Conditions.
When providing Customer contact details to Moleke, the Partner is required to obtain the Customer's consent to share these details for the purpose of Moleke contacting them and presenting Service offers.
The Partner undertakes and guarantees that:
for the purposes of participation in the Partner Program, and in particular in connection with providing Leads, it meets all requirements set out in the Personal Data Protection Rules,
processing personal data for these purposes will not cause Moleke or data subjects to violate Personal Data Protection Rules.
Upon request, the Partner shall release and indemnify Moleke from liability for any violations (in particular of Personal Data Protection Rules, personal rights, or resulting from the Customer receiving unsolicited commercial/marketing information) arising directly or indirectly in connection with acts or omissions of the Partner or persons acting on its behalf. This release from liability is unlimited in amount and applies to all obligations and costs (in particular legal fees, claims, demands, losses, damages, costs of proceedings, and penalties) charged to Moleke due to violations caused by the Partner or persons acting on its behalf.
§ 5. Final Provisions
The Terms and Conditions may be updated and changed. Partners will be informed about changes via the e-mail address provided during registration.
In the event of a change to the Terms and Conditions, the Partner shall have the right to object to its changed content, which will be tantamount to resignation from the Partner Program. The objection must be submitted in electronic form within 14 days of being notified, to the email address indicated in § 5.7. The Partner retains the right to remuneration if the Customer concludes a Service agreement with Moleke by the end of the month following resignation.
Moleke has the right to terminate the Partner Program at any time with prior email notification. The Partner retains the right to remuneration if the Customer concludes a Service agreement with Moleke by the end of the month following termination.
Moleke is not responsible for any damages resulting from violation of the Terms and Conditions by the Partner, and in particular for lost profits of the Customer.
Any disputes arising under the Terms and Conditions shall first be settled amicably between the Parties.
The Terms and Conditions are subject to Polish law and are effective as of December 28, 2022.
